Apple's earnings call is a sign that the lawsuits can never stop

Apple had its quarterly earnings call today, and while looking through the news a thought hit. The financials are proof positive that the lawsuits against Android OEMs and partners can never stop. I'll admit that it sounds like I'm wearing a tinfoil hat, but if you read through the data you'll find one thing that can't be ignored -- Apple makes all of their money on mobile. Apple sells very few (relatively) laptops and desktops when compared to any of their competitors, sales of the iPod are waning, yet they keep making billions from the iPhone and iPad.

Don't be fooled by the images you see online, with rooms full of MacBooks. That's part of the tech bubble effect, and if you were to put 100 "real" people with a laptop in a room, 95 of them would be running Windows. Or 96 if you count Bootcamp. Apple surely enjoys a high profit margin on the OS X hardware they sell, but it's a niche product. That's unlikely to change in the near future. Apple's money and popularity comes from their mobile offerings -- even Steve thought so.

Back to the original thought here -- Apple can't let its hold on the mobile market slip away. Android may have a higher smartphone market share and are slowly creeping up in the tablet arena, but sales of the iPhone and iPad keep growing as well each quarter. Apple has to keep it that way, and they see how easy it would be to lose their spot in the hearts and minds of the public.

Google, and to a lesser (but not to be ignored) extent Microsoft, is slowly gaining ground on the content side. In the U.S., you can get books, magazines, movies, TV shows, music and applications for your Android products right from Google Play. It's really easy, your purchases instantly sync across multiple devices, and things are competitively priced. The real difference between Google Play and iTunes is in the content -- Apple just has more. As this gap grows smaller and smaller (and it will, Google wants your money bad enough to spend their money), there will be a point where new users will look at device features and capabilities for the deciding factor. Long-time users of either platform are less likely to switch over, as your content doesn't follow you from iOS to Android (or vice versa), but new users who aren't invested have a choice. At one point, iTunes was Apple's cash cow -- the amount and quality of the content was what many users used to make their purchasing decision -- but that will change. Even Apple can't keep Hollywood studios and music labels from wanting those Googlebucks, and eventually other countries will cave and licenses will be negotiated. It may cost Google everything it has in its war chest, but it will happen.

When the content is equal, and users look at what the device they are going to spend $700 on, features and ease-of-use become the deciding factor. Folks on the Internet will argue mindlessly about lag or quibble over pixels, but the general public sees things like widgets and pop-up video players on big screens and they are impressed. Fanboy arguments aside, looking at a Galaxy S III beside an iPhone 4S, the iOS simplistic beauty is lost on many consumers. Lost to giant weather widgets and saturated 4.8-inch SAMOLED screens. The more features Apple can have stripped away from Android devices, the better the iPhone and iPad look -- and operate.

We hate (as in hate) the smartphone wars and software patent mess that goes on across the global courts. We would love to see innovators battle each other only with innovation, because we all win with awesome new features on both platforms. But that's just never going to happen. Apple can't let it happen, and when the "next big thing" comes along to take on Android (and it will) Google can't let it happen. Money makes the world go 'round.

Union political donation ballot measure questioned

SACRAMENTO -- Government reform groups lashed out Monday at a ballot initiative that claims its intent is to eliminate special interest money from Sacramento.

At a news conference, leaders from Common Cause California and League of Women Voters said that Proposition 32, dubbed "Stop Special Interest Money Now," is an age-old assault on union power dressed up as campaign finance reform.

"It's not at all what it seems," said Trudy Schafer, of the state League of Women Voters. "It promises political reform but it's really designed by its special interest backers to help themselves and harm their opponents."

The measure was written by a core group of Orange County Republicans who have failed in three statewide campaigns to restrict labor unions' ability to collect members' dues for political purposes. This time, they've attempted to broaden their appeal by seeking to ban corporate and union donations to candidates and campaigns -- in addition to forbidding unions from collecting dues for campaigns.

But opponents said Proposition 32 will not take money out of politics because so-called super PACs and independent expenditure groups will still be allowed to spend unlimited money -- and will likely become even more predominant in campaigns.

In addition, a whole class of major commercial enterprises that are not considered corporations but have similar resources would be exempt from the measure's restrictions, opponents said. The bill does

not apply to limited liability companies (LLCs) like Wall Street investment firms, hedge funds, real estate developers and others, and it specifically exempts insurance companies from the payroll deduction ban, opponents said.

"I'm all for campaign finance reform," said Derek Cressman, western regional director for Common Cause. "I've spent the last 15 years of my life working for campaign finance reform. I know campaign finance reform, and, friends, Prop. 32 is not campaign finance reform."

Bankrolling the measure are a number of investors, CEOs and other wealthy individuals such as Palo Alto's Thomas Siebel, the chairman of the First Virtual Group, who has contributed $500,000.

Still, labor groups view the ballot measure as a deadly threat and have far outpaced supporters in the money chase. Since the most recent finance reports on April 30, they've added $3.4 million to the $3.9 million cash they had on hand for a total of $7.3 million. The Yes side has $1.9 million.

Proponents said there are no exemptions written into the measure, but that it defines corporations as defined under federal and state laws.

"Individuals can give," said Jake Suski, spokesman for the Yes on Proposition 32 campaign. "Prop. 32 is designed to allow individuals to have a stronger voice. And it empowers union members by allowing them to have a direct say over whether their money goes to political causes.

"Opponents want to talk about what the initiative doesn't do because they'll say or do anything that protects the status quo."

Less empowered individuals like teachers need their unions to add a collective voice to the political dialogue, said Lisa Sussman, an Auburn second grade teacher who is politically active with the California Teachers Association.

"It is grossly unfair that corporate special interests want to silence my voice," she said. Proposition 32 "does nothing to fix Sacramento's problems. Its loopholes would only allow the wealthy pushing this attack to increase their influence."

Lancet paper finds novel drug regimen could be more effective than existing treatments; TB Alliance's trial to test drugs in combination saves years in research time

WASHINGTON, DC/LONDON (July 23, 2012) A novel approach to discover the first new tuberculosis (TB) combination drug regimen cleared a major hurdle when Phase II clinical trial results found it could kill more than 99 percent of patients' TB bacteria within two weeks and could be more effective than existing treatments, according to a study published today in the Lancet. These results add to a growing body of evidence that the new regimen could reduce treatment by more than a year for some patients.

The findings from researchers and the non-profit TB Alliance raise hope for a treatment breakthrough amid the growing and dangerous epidemic of drug-resistant forms of TB that, in some cases, are becoming untreatable. The results, presented today at the 2012 International AIDS Conference, also reveal progress in the pursuit of an antiretroviral-compatible TB treatment, which is critical to treating the millions of people with TB/HIV co-infection. Today, TB remains the largest killer of people with AIDS, but very often, TB and HIV treatments cannot be given together because of drug-drug interactions and side effects.

The clinical trial tested a combination of one completely novel drug candidate, a new TB drug candidate already approved to treat other infectious diseases, and one existing TB drug. These results, along with pre-clinical data, suggest that this novel combination could treat both drug-susceptible and some forms of drug-resistant TB in only four months. Currently, people with multi-drug resistant TB (MDR-TB) require 18 to 24 months of treatment. Even those with ordinary TB need six months of taking drugs every day.

"These findings confirm the promise of novel TB regimens to be shorter, simpler, safer, and, compared with today's MDR-TB drugs, much less expensive," said Mel Spigelman, MD, CEO and President of TB Alliance. "The next trial to advance this regimen is already underway. We now have real momentum toward bringing to market treatments that will ultimately help save millions of lives."

TB Alliance's push to test new drugs in combination has been done to produce a regimen that not only would be faster and easier for patients, but also would tackle two other challenges as a major step in stopping the spread of drug-resistant TBthe complexity and high cost of treatment. This promising regimen eliminates the use of injectables and projects to reduce the cost of MDR-TB therapy by as much as 90 percent.

TB is one of the world's most ancient and deadly infectious diseases, dating back thousands of years and found in remains of Egyptian mummies. When HIV/AIDS exploded in the 1980s and 1990s, especially in sub-Saharan Africa, that epidemic triggered a historic jump in the number of TB deaths. An estimated 1.4 million people die from TB, and roughly 9 million people develop the disease, each year. One-third of all people on earthnearly 2.5 billion peoplehave a latent form of TB.

The study, NC-001, or New Combination 1, was a two-week trial successfully completed at two centers in South Africa. It involved the new combination therapy called PaMZ, consisting of the novel TB drug candidate, PA-824; moxifloxacin, an established antibiotic not yet approved for use in first-line TB therapy and being developed in partnership with Bayer Healthcare AG; and pyrazinamide, an existing TB drug. NC-001 was funded by the Bill & Melinda Gates Foundation, the United States Agency for International Development, UK aid, and Irish Aid.

"Treating drug-sensitive and drug-resistant TB with the same regimen can simplify the delivery of TB treatment worldwide," said Andreas Diacon, MD, the trial's principal investigator and lead author of the Lancet study. "The results of this study give healthcare providers on the front lines of the TB epidemic hope for better, faster tools needed to stop this disease."

A second trial called New Combination 2 (NC-002) was launched earlier this year to test the PaMZ combination over two months in patients, further advancing it through clinical development. NC-002 is currently enrolling patients and will be conducted at eight sites in South Africa, Tanzania and Brazil, and will build global capacity for TB trials.

In addition to these results, pharmaceutical companies are seeking regulatory approval for individual TB drug candidatesadvances made possible by the existence of the most promising research pipeline for TB drugs in history. TB experts say any new drugs for tuberculosis would be an extraordinary development, but that new TB drug combinations are potential game-changers due to their expected impact.

The NC-001 trial also validated the approach to development of novel regimens. Mario Raviglione, MD, Director of the Stop TB Department at the World Health Organization, said testing multiple new TB drug candidates simultaneously has already proven to be a major advance.

"Because of testing drugs in combination, we have already saved several years in the research process to find new, effective regimens to treat TB," Raviglione said. "The results look strongly promising from this early trial. If further testing holds up these results and the regimen is affordable in poor countries, it is huge progress. We could shorten drug regimens substantially for everyone, regardless of whether the form of TB is sensitive or multi-drug resistant. That would be a dramatic step forward."

(AP) ? On Friday, finance ministers from the 17 countries that use the euro approved the terms of the bailout of Spain's troubled banking sector.

Here is a glance at the aid package's main points:

?The EU will provide up to ?100 billion ($122.87 billion) for Spanish banks struggling under a mountain of non-performing loans, foreclosed property and other unwanted assets resulting from the collapse of the country's real estate market. The precise figure will depend on how much each bank needs, and this will be determined after detailed portfolio assessments and stress tests due to be completed in September. Leading Spanish banks, such as Banco Santander SA, are not expected to need any help.

?Money from the bailout will be used to help the banks recapitalize and shore up their balance sheets against the prospect of further shocks in the Spanish economy. Spain is currently in its second recession in three years and saddled with a nearly 25 percent unemployment rate.

?The money will be available until the end of next year, and most recapitalization operations are expected to be completed in June of 2013.

?Funds will initially come from the EU's existing bailout mechanism, known as the EFSF ? the same one used in the bailouts of Greece, Ireland and Portugal. The goal is for the money eventually to flow from a planned permanent mechanism, the ESM, directly to the needy banks, rather than to the Spanish government as will be the case at the outset. Under both arrangements, when it comes to repaying, the EU's loans will not take precedence over debt owed to other creditors ? a crucial point for private investors worried that they might not be paid back.

?Toxic assets will be segregated from Spanish banks into an Asset Management Agency, essentially a 'bad bank.' Spain's toxic assets are expected to total about ?200 billion euros.

?The EU has not said what interest rate it will charge. Spain says the rate will be variable and depend on conditions in the money market. Spanish Economy Minister Luis de Guindos has said it would be under 4 percent.

?The average term of the loans will be 12.5 years, and the maximum 15.

?A first tranche of ?30 billion euros will be made available by July 31. But it will be held in reserve by the bailout fund and disbursed only in the event of emergency. The size of the other tranches will be determined depending on the needs of the Spanish banks.

'Seeds' of massive black holes found at the center of the Milky Way galaxy

ScienceDaily (July 20, 2012) ? Many galaxies contain enormous amounts of molecular gas in small areas near their nuclei. Highly condensed molecular gas is a birthplace of lots of stars. Moreover, it is considered to closely relate to activities of galactic nuclei. Therefore, it is important to investigate the physical state and chemical properties of molecular gas at galaxy centers through observation. To obtain detailed observation data, it is best to survey the center of the Milky Way Galaxy in which our solar system exists.

The research team observed emission lines at wavelengths of 0.87 mm, emitted from carbon monoxide molecules in an area of several degrees that includes the center of the Milky Way Galaxy. The ASTE 10 m telescope in the Atacama Desert (4,800 meters above sea level) of Chile was used for observation. More than 250 hours in total were spent on the prolonged observation from 2005 to 2010.

The research team compared this observation data with data of emission lines at wavelengths of 2.6 mm, emitted from carbon monoxide molecules in the same area, which were obtained using the NRO 45m Telescope (Note: 1). When intensity values of emission lines at different wavelengths, emitted from carbon monoxide molecules, are compared, it is possible to estimate temperature and density of molecular gas. In this way, the research team succeeded in drawing detailed distribution maps of "warm, dense" molecular gas of more than 50 degrees Kelvin and more than 10,000 hydrogen molecules per cubic centimeter at the center of the Milky Way Galaxy for the first time ever.

Oka, the research team leader, said, "The results are astonishing." The "warm, dense" molecular gas in that area is concentrated in four clumps (Sgr A, L=+1.3?, L=-0.4?, L=-1.2?). Moreover, it turns out that these four gas clumps are all moving at a very fast speed of more than 100 km/s. Sgr A, one of the four gas clumps, contains "Sagittarius A*," the nucleus of the Milky Way Galaxy. Oka added, "The remaining three gas clumps are objects we discovered for the very first time. It is thought that 'Sagittarius A*' is the location of a supermassive black hole that is approximately 4 million times the mass of the sun. It can be inferred that the gas clump 'Sgr A' has a disk-shaped structure with radius of 25 light-years and revolves around the supermassive black hole at a very fast speed."

On the other hand, the team found signs of expansion other than rotation in the remaining three gas clumps. This means that the gas clumps, L=+1.3?, L=-0.4?and L=-1.2?, have structures that were formed by supernova explosions that occurred within the gas clumps. The gas clump "L=+1.3?" has the largest amount of expansion energy. Its expanding energy is equivalent to 200 supernova explosions. The age of the gas masses is estimated as approximately 60,000 years old. Therefore, given that the energy source is the supernova explosions, the supernova explosions have continued to occur every 300 years.

The research team used the NRO 45m Telescope again to further examine the molecular gas's distribution, motion and composition to determine whether supernova explosions caused the expansion. "Observation clearly showed that the energy source of L=+1.3? is multiple supernova explosions. We detected multiple expansion structures and molecules attributed to shock waves," Oka said about the excitement when observing it. "Based on the observation of L=+1.3?, it is also natural to think that the expanding gas clumps L=-0.4? and L=-1.2? derived energy from multiple supernova explosions," Oka added.

A supernova explosion is a huge explosion that occurs when a star with more massive than eight to ten times the mass of the sun ends its life. Such a high occurrence of supernova explosions (once per 300 years) indicates that many young, massive stars are concentrated in the gas clumps. In other words, this means that there is a massive "star cluster" in each gas clump. Based on the frequency of the supernova explosions, the team estimated the mass of the star cluster buried in L=+1.3?as more than 100,000 times the mass of the sun, which is equivalent to that of the largest star cluster found in the Milky Way Galaxy.

As just described, the star cluster is huge, but it had not been discovered until now. "The solar system is located at the edge of the Milky Way Galaxy's disk, and is about 30,000 light-years away from the center of the Milky Way Galaxy. The huge amount of gas and dust lying between the solar system and the center of the Milky Way Galaxy prevent not only visible light, but also infrared light, from reaching the Earth. Moreover, innumerable stars in the bulge and disc of the Milky Way Galaxy lie in the line of sight. Therefore, no matter how large the star cluster is, it is very difficult to directly see the star cluster at the center of the Milky Way Galaxy," Oka explained.

"Huge star clusters at the center of the Milky Way Galaxy have an important role related to formation and growth of the Milky Way Galaxy's nucleus," said Oka. According to theoretical calculations, when the density of stars at the center of star clusters increases, the stars are merged together, one after another. Then, it is expected that IMBHs with several hundred times the mass of the sun are formed. Eventually, these IMBHs and star clusters sink into the nucleus of the Milky Way Galaxy. It can be thought that the IMBHs and star clusters are then merged further, and form a massive black hole at the Milky Way Galaxy's nucleus. Alternatively, the IMBHs and star clusters could help expand an existing massive black hole.

It can be thought that the supermassive black hole at "Sagittarius A*," the nucleus of the Milky Way Galaxy, has also been grown up through these processes. In summary, the new discovery is the finding of "cradles" of IMBHs that become "seeds" of the supermassive black hole at the nucleus.

"We would like to observe IMBHs in the star cluster. Actually, our observation data has already indicated traces of IMBHs," Oka said. One of the newly discovered gas masses, "L=-0.4?," contains two small gas clumps moving at a very fast speeds. If it is confirmed that these small gas clumps are rotating, it can be inferred that there are "invisible huge masses" at the center of the gas clumps. These "invisible huge masses" are likely to be IMBHs hidden in the center of the star cluster. Professor Oka expects developments in future research, saying, "In order to confirm the existence of IMBHs, we are planning to conduct further observations. The new discovery is an important step toward unraveling the formation and growth mechanism of the supermassive black hole at the Milky Way Galaxy's nucleus, which is a top-priority issue in galactic physics."

Bulgaria releases video of bomber in attack on Israelis

Bulgarian authorities have released a video of the suspected suicide bomber behind a deadly attack on Israeli tourists that Israel has blamed on Iran.

US investigators from the FBI joined the investigation into Wednesday's bombing of a bus at a Black Sea airport that killed six people and wounded more than 30 as international condemnation of the attack grew.

Israel on Thursday blamed Iran and the Lebanese group Hezbollah. Iran described the accusations as "ridiculous".

Five tourists were killed at the scene. The Bulgarian driver died later in hospital, officials said. Thirty-two people were wounded.

The remains of the Israeli victims arrived early Friday at Ben Gurion airport in Tel Aviv.

The five coffins, with Israeli flags draped over them, were taken off a military plane that landed at 12:30 am Friday (2130 GMT Thursday). Dozens of mourning relatives had gathered for the plane's arrival.

Israel published the names of those killed. They were identified as four men in their twenties -- Yitzhik Kolengi, Amir Menashe, Elior Priess, and Maor Harush -- and Kochava Shriki, 44, who was pregnant.

The funerals will take place on Friday.

Many of the wounded, including teenagers, also arrived back in Tel Aviv after being flown home by the Israeli air force.

They included a pregnant woman and a young girl who was carrying a sandal because her right foot was wrapped in bandages.

Many had been taken in wheelchairs to ambulances to board the flight home, some still with their blood-stained holiday clothes on.

"The suicide bomber, wearing shorts and carrying a backpack, looked like any other tourist," said Bulgarian Interior Minister Tsvetan Tsvetanov.

Authorities released a video showing a white man with long hair, possibly a wig, and sunglasses wandering around Burgas airport.

Tsvetanov said he appeared to be aged about 26 and had a fake driving licence from the US state of Michigan.

The authorities had taken fingerprints and were being helped by the FBI, Interpol and Europol to discover the bomber's identity, the minister said.

The explosion ripped through the bus as around 50 Israeli tourists arriving from Tel Aviv were loading their bags before travelling to a nearby holiday and gambling resort.

Witnesses described how panicked passengers jumped from bus windows and bodies lay strewn on the ground with their clothes torn off.

"I would have lost my life in a split-second, had I not jumped out of the bus's window," survivor Moshe Moseri told Israeli news website Walla, describing seeing "corpses on the floor with their arms and legs severed".

Israeli Prime Minister Benjamin Netanyahu said the attack was part of "a global campaign of terror carried out by Iran and Hezbollah".

US President Barack Obama condemned the "barbaric" bomb attack.

"I want everybody to know, under my administration, we haven't just preserved the unbreakable bond with Israel, we have strengthened it," Obama told a mainly elderly audience at a campaign event in West Palm Beach.

The diplomatic Quartet on the Middle East peace process -- the European Union, Russia, the United Nations and United States -- branded the attack as "brutal" and an "act of cowardice" against innocent victims.

The UN Security Council said in a statement it "condemned in the strongest terms the terrorist attack aimed at Israeli tourists".

Iran's state television said Israel's "ridiculous" accusations were "aimed at creating an anti-Iranian atmosphere" amid rising tensions over Tehran's nuclear drive which the West suspects is aimed at building atomic weapons.

"The Zionist regime, which is responsible for terrorist acts organised in Lebanon, Palestine and against Iranian nuclear scientists... is launching baseless accusations against other countries to forget its own terrorist nature," a foreign ministry spokesman said.

The bomber struck on the 18th anniversary of an attack on a Jewish community centre in Argentina that killed 85 people and was also blamed on Iran.

On top of the condemnation, several countries have increased security, including Cyprus and Bulgaria's neighbour Austria.

Burgas airport reopened under heavy security with all traces of the attack removed, although the bomb site remained off-limits behind police tape.

A cordon was set up around the airport building where people had to have all bags checked.

Austria, which is home to about 10,000 Jews, said it had taken extra security measures at Jewish community buildings, airports and for groups of Israelis in the country.

The bus wreckage was loaded on to a truck and taken away, along with another bus that also caught fire in the blast and which had a large blood stain down its side.

Israel and Bulgaria have good relations and the Black Sea coast has become a popular holiday spot for Israelis, with almost 140,000 visiting the country in 2011. About 13 percent of the Bulgarian population is Muslim.
